LinkLiberator is a content sharing platform that empowers creators to connect their audiences with their most recent and relevant content. At LinkLiberator, we value individual freedom, liberty and autonomy.

By accessing and using our services – including the website (https://linkliberator.com/), apps, and related software or features (collectively referred to as the “Platform” or “LinkLiberator”), you agree to abide by these Terms of Use (“Terms”). These Terms, along with any linked policies, govern your use of LinkLiberator. If you do not agree with these Terms, please refrain from using LinkLiberator.

Throughout these Terms, the terms “we,” “our,” or “us” refer to 17 Solutions LLC, the company behind LinkLiberator. Please take the time to carefully read these Terms. If you have any questions, feel free to reach out to us.

Amendments to Terms

As a platform committed to continuous improvement and evolution, we may make changes to the Platform or these Terms from time to time. Changes may be made to reflect updates in our business operations, modifications to the Platform, legal or commercial considerations, or to safeguard our legitimate interests.

We reserve the right to modify these Terms at any time. It is your responsibility to review these Terms periodically for any updates. By continuing to use LinkLiberator after any modifications to the Terms, you signify your acceptance of the revised Terms. If you do not agree with the changes, please discontinue using LinkLiberator.

Account Creation and Usage

To create an account and become a user of LinkLiberator, you must be at least 18 years old. If you are creating an account on behalf of someone else, you must have their explicit consent to do so. You are responsible for ensuring that your account is used lawfully and in compliance with these Terms.

By creating an account, you agree to adhere to these Terms and certify that you are of legal age to enter into this agreement. You must provide accurate information about yourself, and promptly update any changes to your account details.

If you are using LinkLiberator on behalf of a business or individual, you affirm that you have the authority to agree to these Terms on their behalf. You are responsible for all activities associated with your account, so please keep your login credentials secure and do not share them with others.

If you suspect unauthorized access to your account, please notify us immediately. You are prohibited from transferring or assigning your account to others, or using your account in a manner that may damage LinkLiberator or infringe upon the rights of others.

Username Selection

When creating a LinkLiberator profile, you must select a username that respects the rights of others and adheres to our principles. Your username must not infringe upon the intellectual property rights of others, including copyrights and trademarks. Additionally, usernames should not be offensive, vulgar, or selected with the intent of name squatting.

We reserve the right to evaluate usernames and may request changes if deemed necessary. Failure to comply may result in the suspension or termination of your account. In case of disputes over username rights, we will follow a fair assessment process and may reassign or reclaim usernames after contacting the account holder.

Plan Management

You can choose between free or paid plans on LinkLiberator, and you have the flexibility to cancel your plan at any time. Paid plans will commence upon acceptance of these Terms and will continue until cancellation. If you cancel a paid plan, it will remain active until the end of the billing cycle, after which it will convert to a free plan.

Refunds for payments are generally not provided, except in specific circumstances outlined in our refund policy. If you cancel a paid plan within 72 hours of signing up, exceptions may be considered. Please contact us at [email protected] for assistance with cancellations or refunds.

User Content

At LinkLiberator, we celebrate the diverse range of content shared by our users. However, we prioritize the safety and well-being of all Platform visitors, which is why we have established Community Standards. Users are expected to adhere to these standards, and failure to do so may result in the suspension or removal of your account.

Your "content" refers to any materials, including text, graphics, videos, links, or other materials, that you add to your LinkLiberator profile. By posting content, you affirm that:

  • You hold the rights to the content or have obtained necessary permissions.
  • Your content does not infringe upon the rights of others or violate any laws.
  • Your content is truthful, accurate, and does not harm our reputation.
  • Your content is free from harmful elements such as viruses or disruptive code.
  • You refrain from using automated collection tools or unauthorized advertisements on LinkLiberator.
  • Your content aligns with our Community Standards.

We reserve the right to remove or restrict access to content that violates these Terms or poses a risk to the safety of our users. Additionally, we may take appropriate action to address content that is legal in some jurisdictions but not others.

Use of Your Content

When you post content on LinkLiberator, you grant us a license to use and display that content on the Platform and in our marketing materials. This license is non-exclusive, worldwide, and perpetual, allowing us to utilize your content for promotional purposes without compensation to you. You retain all rights to your content, but please be aware that it may be publicly accessible and shared by others on LinkLiberator and across the internet.

Please exercise caution when sharing personal information on LinkLiberator, and refrain from posting sensitive details that could be exploited. Only share personal information with consent and maintain records of such consent. While we do not actively monitor content for accuracy or legality, we reserve the right to review and remove content that violates these Terms.

Account Suspension or Cancellation

Failure to comply with these Terms may result in the suspension or cancellation of your account. We may also adjust the functionality of the Platform for non-compliant users. The severity of action taken will depend on the nature and frequency of non-compliance. While we strive to provide notice before suspending or canceling accounts, we are not obligated to do so.

Please note that fees paid in advance are non-refundable in the event of account suspension or cancellation. If you believe your account was mistakenly terminated or encounter issues with these Terms, please contact us at [email protected]. We are committed to resolving disputes in good faith, and legal action will only be pursued after a collaborative effort to find a resolution.

User Responsibility for Visitors and Customers

As a LinkLiberator user, you are responsible for the interactions and transactions conducted with your profile visitors, including customers who purchase goods or services through your LinkLiberator links. You must ensure compliance with all applicable laws governing these interactions and transactions.

Feedback

We value your feedback and ideas for improving LinkLiberator. From time to time, we may introduce beta features for user testing and seek feedback from the community. By providing feedback, you grant us the right to use it for any purpose without compensation. Please be aware that beta features are still under evaluation and may not be as reliable as other Platform functionalities.

Ownership of the Platform

As the owners of LinkLiberator, we grant you a limited right to use the Platform for sharing content and interacting with other users. However, we are not responsible for the content, products, or services offered by other users. All rights, including Intellectual Property (IP) Rights, related to the Platform (excluding user content), are owned by 17 Solutions LLC or our licensors. You are not permitted to use LinkLiberator IP without prior written approval.

You are granted a limited, revocable, non-exclusive, and non-transferable right to use the Platform in accordance with these Terms. Please adhere to any guidelines provided for using Platform resources, and refrain from altering or misusing proprietary notices or trademarks.

When visiting other LinkLiberator profiles as a visitor, you are granted a limited right to view and interact with content. We are not liable for content posted by other users, and you access such content at your own risk.

Fees and Payment

Subscription Fees:

If you’ve opted for a paid plan, it's important to ensure timely payment of subscription fees. These fees are typically denominated in USD and may include transactional taxes such as GST/VAT, unless otherwise specified. Subscription fees are billed in advance on a recurring basis, depending on your chosen billing cycle (monthly or annually). Your paid plan will automatically renew at the end of each billing cycle under the updated Terms unless you opt to cancel. Upon sign-up, please provide accurate billing details and a valid payment method (such as a credit card). Authorization for recurring charges allows us to bill applicable fees. In the event of automatic billing failure, you will receive an online invoice that must be settled within the specified timeframe.

Changes in Fees and Advance Notice:

We may periodically adjust subscription or transaction fees. In the event of any changes, we will provide advance notice, typically at least one month in advance. If you disagree with the updated fees, you have the option to cancel your plan before the next billing cycle commences.

Privacy

At LinkLiberator, safeguarding your privacy and that of your Profile Visitors is our utmost priority. Our Privacy Notice outlines how we handle your personal data for internal purposes.

All data, including associated intellectual property rights, generated from your use (or the use of profile visitors or other users) of the Platform or content ("Data"), will be owned by LinkLiberator. As part of the services offered on the Platform, we may provide you with Data or visual representations thereof, termed "Data Analytics." While we make no warranties about the accuracy or completeness of Data Analytics, we endeavor to ensure their accuracy and completeness.

Confidentiality

From time to time, we may share confidential information with you (e.g., disclosing upcoming features during beta testing). If we share any confidential information about LinkLiberator or the Platform with you, you must maintain its confidentiality and security. You are also required to employ reasonable measures to prevent unauthorized access to this information.

Liability

We want to clarify that we are not liable for your use of the Platform, and it is essential that you maintain backups of your own content. We disclaim liability for any damages resulting from actions such as downloading, installing, or utilizing the Platform, or copying, distributing, or downloading content from it. You are responsible for ensuring the protection and backup of your data, content, and devices while using the Platform.

You agree to indemnify us against any losses arising from your breach of these Terms or a third party's claim related to your content. Neither party will be liable for indirect, punitive, special, incidental, or consequential damages, including but not limited to losses in business, revenue, profits, privacy, data, goodwill, or other economic benefits, regardless of the cause.

Our liability to you under these Terms or related to the Platform will not exceed the fees paid to us in the 3-month period preceding the liability.

Disclaimers

We want to make some important disclaimers within these terms. When you use LinkLiberator and access any content on the Platform, you do so at your own risk. The Platform is provided to you "AS IS" and "AS AVAILABLE," without any warranties of any kind, whether express or implied, including (but not limited to) uptime or availability, or any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

LinkLiberator, its affiliates, and licensors do not make any express or implied warranties or representations, including that:

  • The Platform will function without interruption or be available at any time or place;
  • Any errors or defects will be corrected;
  • The Platform is free of viruses or other harmful components;
  • The Platform is effective or that the results of using the Platform will meet your needs; or
  • Any content on the Platform (including user content) is complete, accurate, reliable, suitable, or available for any purpose.

These Terms apply to the maximum extent permitted by law, and nothing in them is intended to exclude, restrict, or modify legal rights that you may have, which cannot be excluded, restricted, or modified by contract. If these Terms are governed by the Australian Consumer Law, our liability to you for not complying with a consumer guarantee is limited to the re-supply of the services or payment.

Third Party Services

LinkLiberator collaborates with various third-party products and services. We may provide access to specific third-party features or services within the Platform, such as a payment portal or an online store. Unless explicitly stated otherwise, we do not endorse or make any warranties about any third-party products or services, nor do we offer refunds for payments made to third parties. Your use of any third-party product or service may be subject to separate terms and conditions, which you are responsible for reviewing, accepting, and complying with. Failure to accept or adhere to these third-party terms may result in the suspension, cancellation, or limitation of your account or access to these services on our Platform.

If we are required to display specific third-party terms on our website, you can find them at the bottom of this page. Additionally, our Privacy Notice includes a list of our subprocessors.

Open Source

The app may include open-source software components, and some of these components are subject to their own specific license terms. You can find these terms in our Open-Source Content library, accessible in the ‘Legal’ section of the app. If the license terms of a particular open-source component do not align with our terms outlined here, then these Terms will not cover that component. Instead, the relevant license terms will govern your rights and responsibilities for that specific component.
